Terms of Use

These Terms of Use govern your use of www.titanimplants.com and our digital media. Every purchase is also governed by our Terms and Conditions of Sale, which control if the two conflict on anything related to a purchase.

1. Acceptance

Titan Implants, Inc. provides this Site subject to these Terms. By accessing the Site, creating an account, placing an order, or interacting with our digital media channels (including embedded social media content and video reels), you accept these Terms and every policy incorporated by reference, including our Privacy Policy and our Terms and Conditions of Sale. If you do not agree, do not use the Site.

2. Definitions

• "Titan Implants," "we" or "us" means Titan Implants, Inc., 18 Columbia Avenue, Bergenfield, New Jersey 07621, USA.
• "You" means any individual, licensed professional, dental laboratory or business entity that uses the Site or purchases Products.
• "Site" means www.titanimplants.com, together with the linked digital content, social media channels, embedded video and digital media managed by Titan Implants.
• "Products" means the components, instruments and other goods offered by Titan Implants, referred to as "Goods" in our Terms and Conditions of Sale.
• "Terms" means these Terms of Use, together with our Terms and Conditions of Sale and all incorporated policies.

3. Privacy and Security

Our handling of personal information is governed by our Privacy Policy at titanimplants.com/privacy-policy, which forms part of these Terms. We use commercially reasonable safeguards to protect information you submit. No method of electronic transmission or storage is completely secure, however, and we cannot guarantee its security.

To the fullest extent permitted by law, Titan Implants is not liable for any direct, indirect, special, incidental or consequential damages, including lost profits, resulting from unauthorized access to or interception of information despite those safeguards.

4. Use of the Site and Digital Media

License. We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Site for your professional purposes, including viewing and downloading materials and purchasing Products. You may not use the Site for any unlawful purpose. You may not reproduce, modify, distribute, publicly display, sell, lease, translate or otherwise commercially exploit any part of the Site, use it for the benefit of another business, or interfere with its operation or security.

Accuracy of information. Content on the Site and in our videos is general educational and product-selection guidance. We aim to keep specifications such as platform diameters, seating surface dimensions and torque values accurate and current, but we make no warranty that all information is complete or error-free. Confirm specifications against the product labeling and Instructions for Use (IFU) before clinical use.

Clinical disclaimer. Information and technique demonstrations, including videos showing abutment preparation, emergence profile creation or Implant Locator Pin use, are not medical or dental advice for any individual patient. The treating dental professional is solely responsible for case selection, technique and clinical judgment, and should complete appropriate training in dental implantology before placing or restoring implants.

Videos and educational content. Reels, demonstrations and downloadable technique guides are illustrative. They do not replace formal postgraduate implant training, hands-on surgical or restorative protocols, or the product's IFU.

5. Products, Compatibility and Regulatory Status

Products. Titan Implants manufactures abutments, analogs and accessories in the USA, designed to be compatible with major implant systems. Our titanium abutments are machined from Grade 23 ELI titanium (Ti-6Al-4V ELI, ASTM F136).

Prescription devices. Federal (USA) law restricts these devices to sale by or on the order of a licensed dentist or physician. Products are sold only to licensed dental professionals and to dental laboratories acting on a licensed professional's order.

Professional purchasers. By creating an account or placing an order, you represent that you are a licensed dental professional, or a dental laboratory or practice purchasing on a licensed professional's order, and that the Products are for professional use. We do not sell to patients or the general public. We may request proof of licensure and may decline or cancel any order that does not meet these requirements.

Compatibility. References to third-party implant systems identify compatible connections only. You are responsible for confirming the implant system, connection type and platform before ordering and before use.

Images and videos. Images, 3D renderings and videos are for illustration and identification only. They are not necessarily to scale and may differ from the actual product or its packaging.

Availability. Products and compatibility offerings may vary by country and by regulatory status. Contact us for availability in your region.

Custom-made and special orders. Custom-made items and special orders made to your specifications are Final Sale. They cannot be returned, and they cannot be cancelled once the order is placed without our prior written consent. You are fully responsible for custom-made and special orders. See Sections 6(f), 8(b) and 9 of our Terms and Conditions of Sale.

6. Your Account

You need an account to order online. You are responsible for keeping your login credentials confidential and for all activity under your account, whether or not you authorized it, including all orders, communications and transactions. Notify us immediately at support@titanimplants.com or (201) 439-0470 if you learn of any unauthorized use of your account or any breach of security.

7. Suspension and Termination

We may suspend or terminate your access to the Site or your account at any time, without prior notice, if we believe you have breached these Terms, or for any other business reason at our sole discretion. We are not liable to you or any third party for any suspension or termination. Orders accepted before termination remain governed by our Terms and Conditions of Sale.

8. Pricing and Typographical Errors

If a Product is listed at an incorrect price or with incorrect information because of a typographical, system or supplier error, we may refuse or cancel any order for it. This applies even after the order is confirmed and your payment is charged. We will notify you and offer the Product at the correct price. If you decline, or if we cancel, we will promptly credit any amount charged for the cancelled items.

9. Intellectual Property

All Site content is owned by or licensed to Titan Implants, Inc. and protected by copyright, trademark, patent, unfair competition and other intellectual property laws. This includes text, graphics, logos, button icons, images, photographs, engineering drawings, video reels, social media broadcasts, product selection guides, interfaces and software, and the selection and arrangement of that content. You may not download our videos, educational content or web assets in order to re-edit, re-upload or commercially redistribute them without our written permission.

10. Trademarks and Independent Manufacturer

Our marks. Titan Implants®, Implant Locator Pin™ and associated logos are trademarks of Titan Implants, Inc. You may not use our marks without our prior written consent, in any way likely to cause confusion, in any way that disparages or discredits us, or in metatags, keywords or hidden text.

Third-party marks. All third-party product names, trade names and trademarks referenced on the Site or in our videos, including NobelReplace®, Replace Select®, All-on-4®, Brånemark System®, Straumann®, SynOcta®, Biomet 3i®, Zimmer Dental® and BioHorizons®, are the property of their respective owners. The full list of third-party marks referenced on the Site appears in the Site footer.

Independent manufacturer. Titan Implants, Inc. is an independent manufacturer of compatible prosthetic components. References to third-party marks are used solely to identify compatibility and do not imply any affiliation, partnership, sponsorship, joint venture or endorsement.

11. Testimonials

Testimonials on the Site reflect the personal experience and opinion of the individual who gave them. Clinical results vary from case to case.

12. External Links

The Site may link to third-party websites, such as payment processors, carriers and video platforms, for your convenience. We do not control those sites and are not responsible for their content, availability or practices. Your use of any linked site is at your own risk and subject to its terms.

13. Disclaimers and Limitation of Liability

THE SITE AND ITS CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT PERMITTED BY LAW, TITAN IMPLANTS DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, REGARDING THE SITE AND ITS CONTENT, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY AND NON-INFRINGEMENT.

IN NO EVENT SHALL TITAN IMPLANTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, INCLUDING LOST EARNINGS, LOST PROFITS OR CLINICAL PRACTICE LIABILITIES, ARISING FROM ACCESS TO OR USE OF THE SITE OR ANY LINKED SITE, OR FROM RELIANCE ON SITE MATERIALS OR VIDEOS.

You assume all risks and responsibility arising from the selection, placement, torque application and clinical use of Products, whether used alone or with third-party implant fixtures. Warranties, remedies and liability for Products are governed exclusively by Sections 5 and 6 of our Terms and Conditions of Sale.

14. Promotions, Discounts and Free Shipping

Offers. Promotional codes, volume discounts and online offers are valid while supplies last, are subject to their stated terms, and are void where prohibited. Unless an offer states otherwise, offers cannot be combined with each other, with rebates or with custom pricing agreements, and each promotional code may be used once per customer.

Final sale. Items bought at a promotional price are Final Sale and cannot be returned, as set out in Section 9 of our Terms and Conditions of Sale. Free shipping terms and eligible areas are listed on our Shipping page.

Discount reporting. Discounts applied to an order are reflected on its Invoice. You are responsible for properly disclosing and reflecting any discount or rebate on cost reports or claims submitted to government or other third-party payers where required by law.

15. Use Outside the United States

The Site is operated from New Jersey, USA, and its information is intended for customers in the United States. If you access the Site from another country, you are responsible for complying with local laws, including import and medical device regulations. International purchases are subject to Section 10 of our Terms and Conditions of Sale.

16. Changes to These Terms

We may update these Terms at any time without prior notice by posting the revised version on the Site. The current version is always linked from the footer of every page. Your continued use of the Site after a change means you accept it. A change does not affect orders accepted before the change takes effect.

17. Governing Law and Venue

These Terms, and all disputes or claims arising from use of the Site, our digital media or the purchase of Products, are governed by the laws of the State of New Jersey, USA, without regard to conflict-of-laws principles. The United Nations Convention on Contracts for the International Sale of Goods (CISG) does not apply.

Any legal action or proceeding arising from or related to these Terms or the Products must be brought exclusively in the federal or state courts located in Bergen County, New Jersey, USA, and you consent to the personal jurisdiction of those courts.
